SERVICE TERMS AND CONDITIONS

Introduction

This document is an electronic record under the Information Technology Act, 2000 and is published pursuant to Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

These Terms govern your use of the website book.chqme.com and all demonstration, installation, and service-booking features offered through it ("Platform").

Your use of the Platform and all services, features, and tools made available through it shall be governed by these Terms and Conditions ("Terms"), together with all policies that are incorporated into these Terms by reference. By accessing, browsing, booking, or otherwise using the Platform, you acknowledge and agree that you are entering into a binding agreement with Checkme Commerce Private Limited and that these Terms constitute your enforceable obligations.

For the purposes of these Terms, "You" or "User" means any natural or legal person who accesses or uses the Platform, whether or not such person creates an account. The terms "We", "Us", and "Our" refer to Checkme Commerce Private Limited.

Accessing, browsing, or continuing to use the Platform shall be deemed as your acceptance of these Terms, together with all applicable policies as may be updated from time to time.

Definitions

  • "Platform" means the website and digital interfaces operated by Checkme Commerce Private Limited.
  • "Services" means pre-sales demonstrations, post-sales demonstrations, installations, and related scheduling.
  • "User" means any natural or legal person who accesses or uses the Platform.
  • "Technician" means any individual assigned by Checkme Commerce to perform Services.
  • "Booking" means a service appointment requested through the Platform.
  • "Confirmation" means the communication issued by the Platform approving a Booking.

Eligibility

You must have the legal capacity to enter into a binding contract under Indian law to use the Platform or book any service. Users under 18 years of age may access the Platform only under the supervision of a parent or legal guardian who shall be deemed to have accepted these Terms on their behalf. We may deny or suspend access, cancel bookings, or terminate any use of the Platform if we have reason to believe that a user is ineligible, has misrepresented age or identity, or is otherwise not competent to contract.

Your Account

You are responsible for maintaining the confidentiality of your login credentials and all activity carried out through your account. You shall ensure that all information you provide on the Platform is accurate, current, and complete. If any information is found to be false, inaccurate, incomplete, or misleading, or if we reasonably believe that such information is not in accordance with these Terms, we may suspend, restrict, or terminate your access to the Platform without further notice.

Your registered mobile number and e-mail address function as your primary identifiers on the Platform. You are responsible for keeping these details updated at all times. If your mobile number or e-mail address changes, you shall update it on the Platform through the verification process provided. Failure to update correct contact information may result in loss of access, failed notifications, or disruption of service bookings, for which we are not responsible.

If you permit any other person to access or use your account, whether by sharing your login credentials or otherwise, you shall bear full responsibility for all actions, omissions, and consequences arising from such use. Unauthorized access resulting from your failure to safeguard your credentials shall be treated as your own act.

You must not share your username, password, or one-time passwords with any other person. Sharing or exposing login credentials constitutes a breach of these Terms.

You shall ensure that you log out of your account at the end of each session. You shall immediately notify us of any suspected unauthorized use of your account or any breach of security. If we believe your account security is compromised, we may require you to change your password or we may suspend your account for such duration as we consider necessary. We are not liable for any loss or damage arising from your failure to comply with these requirements.

Your account provides access solely to the services offered by Checkme Commerce Private Limited. There is no shared login, identity linkage, or account interoperability with any other company or platform.

Platform Usage

You agree, undertake, and confirm that your use of the Platform shall be strictly governed by the following principles:

You shall not host, display, upload, modify, publish, transmit, update, or share any information that:

  • belongs to another person and to which you do not have lawful rights;
  • is harmful, harassing, defamatory, obscene, pornographic, paedophilic, invasive of privacy, hateful, discriminatory, threatening, abusive, or otherwise unlawful under applicable laws;
  • is misleading, false, inaccurate, or deceptive in any manner;
  • promotes racism, hatred, physical harm, or any form of violence;
  • harasses or encourages harassment of another person;
  • involves sending unsolicited communication, spam, chain letters, or mass messaging;
  • promotes or encourages illegal conduct;
  • infringes any intellectual property right, privacy right, publicity right, or other proprietary right of any third party;
  • contains unauthorized copies of copyrighted material or any content that violates applicable copyright laws;
  • contains hidden pages, password-restricted content, or inaccessible links not intended for public access;
  • exploits individuals in a sexual, violent, or otherwise inappropriate manner;
  • provides instructions for illegal activities, including hacking, creating malware, or violating privacy;
  • includes images or videos of any person without lawful consent;
  • attempts to gain unauthorized access to the Platform, user accounts, data, or connected systems;
  • conducts any commercial activity on the Platform without our prior written consent, including promotions, advertisements, contests, or solicitations;
  • engages in or promotes gambling or activities construed as illegal under Indian law;
  • disrupts or interferes with another user's access or enjoyment of the Platform;
  • links to content that violates these Terms or contains inappropriate, illegal, or harmful material;
  • harms minors in any manner;
  • violates any applicable law in force in India;
  • deceives or misleads others about the origin of information or impersonates another person;
  • contains viruses, trojans, worms, malware, or any code designed to interrupt, damage, or limit functionality of systems or data;
  • threatens the unity, integrity, security, or sovereignty of India or public order.

You shall not use any automated tools such as spiders, scrapers, bots, or similar mechanisms to access, copy, or monitor any part of the Platform.

You shall not attempt to breach, scan, or test the security or authentication measures of the Platform or connected systems.

You shall not reverse-engineer, decompile, or tamper with any portion of the Platform.

You shall not take any action that imposes an unreasonable load on the Platform infrastructure.

You shall not forge headers, manipulate identifiers, or disguise the origin of any message sent through the Platform.

You shall not impersonate any person, entity, service technician, or representative of Checkme Commerce.

You shall not use the Platform for any unlawful purpose or in violation of these Terms.

We may disclose information, including identity details, if required by law or if necessary for investigation of suspected illegal activity.

We may restrict, suspend, or terminate Platform access if your conduct violates these Terms or creates operational, legal, or security risks.

Intellectual Property

All intellectual property rights in the Platform, including its design, layout, interface, text, graphics, icons, software, databases, logos, service marks, and other content, are owned by or licensed to Checkme Commerce Private Limited. No User shall reproduce, distribute, modify, publish, transmit, create derivative works from, or commercially exploit any portion of the Platform without prior written consent from Checkme Commerce. Access to the Platform does not confer any license or right to use any intellectual property owned or controlled by Checkme Commerce or its partners. Any unauthorized use of intellectual property may result in termination of access and prosecution under applicable laws.

Service Limitations

Services are limited strictly to demonstrations and standard installations. Services do not include product repairs, diagnostics, warranty support, technical troubleshooting, replacement of defective items, rewiring, structural modification, or any task not expressly identified as a demonstration or installation. No verbal statements by technicians modifies this limitation.

Service Scope

The Platform facilitates the booking and coordination of pre-sales demonstrations, post-sales demonstrations, standard installations, and related service appointments for supported brands and products. The Platform is a service-booking interface only. It does not sell, advertise, market, distribute, or supply any products. It does not provide product repairs, diagnostics, warranty services, or technical support beyond demonstrations and standard installations. The Platform is not an e-commerce marketplace, does not participate in product transactions, and does not represent or act on behalf of any product manufacturer or seller in respect of product performance, defects, warranties, or after-sales obligations.

Service Booking and Confirmation

Service appointments are scheduled strictly on the basis of technician availability, geographic service coverage, product category, and operational capacity at the time of booking. A booking submitted through the Platform constitutes a request and shall not be treated as confirmed unless and until you receive an explicit confirmation message issued through the Platform. Confirmation may be withheld, delayed, or modified based on workload, route feasibility, safety considerations, access limitations, or any other operational constraints.

All appointment windows are indicative and may vary due to traffic conditions, unforeseen delays, weather disruptions, high-volume periods, technician rerouting, or any other logistical factors.

Recording of Video Demonstrations

Video-based demonstrations conducted through the Platform may be recorded for quality assurance, training, audit, dispute resolution, fraud prevention, and internal compliance purposes. By booking or participating in a video demonstration, the User expressly acknowledges and consents to such recording. Where required by applicable law, appropriate notice of recording shall be provided prior to commencement of the session. Recordings shall be used strictly for internal and lawful purposes and handled in accordance with the applicable data protection laws, including the Digital Personal Data Protection Act, 2023, and the Privacy Policy. Recordings shall not be shared publicly or with third parties except where required for legal compliance, enforcement of rights, or resolution of disputes. If the User does not consent to recording, the video demonstration may be declined, discontinued, or offered only through non-video alternatives, subject to service availability.

Rescheduling and Cancellation

Users may reschedule or cancel a service booking at any time prior to technician dispatch. Once a technician has been assigned and is en route to the service location, rescheduling or cancellation may not be permitted. If the user is unavailable or unreachable at the scheduled time, the appointment may be marked as a no-show, and any subsequent rebooking may require payment of an additional charge or service fee.

Customer Responsibilities

You shall treat all technicians and service personnel with dignity, courtesy, and respect. Any form of discrimination against a technician on the basis of caste, religion, race, ethnicity, language, nationality, gender, gender identity, sexual orientation, disability, age, or any protected characteristic under applicable law is prohibited.

You shall not engage in abusive, aggressive, threatening, or discourteous behaviour toward any technician or service personnel.

You shall provide safe, unobstructed access to the premises for the purpose of completing a demonstration or installation. Unsafe, hostile, or unlawful conditions may result in immediate withdrawal of the technician from the location and cancellation of the service.

You shall ensure that all necessary site conditions required for installation, such as power supply, space, fixtures, and structural readiness are prepared in advance.

We may suspend or restrict your access to the Platform, cancel current bookings, or refuse future bookings if you engage in conduct towards any technician or staff member that is discriminatory, abusive, inappropriate, or otherwise unlawful.

Technician Responsibilities

Technicians are trained and authorized solely to perform demonstrations and standard installations in accordance with the applicable brand guidelines. They shall not conduct repairs, diagnose product defects, modify electrical wiring or fittings, alter product components, or perform any task that falls outside the defined service scope. Technicians may refuse to proceed with any activity that is unsafe, unauthorized, not supported by brand instructions, or beyond the limits of their training.

Installation Conditions

Installation can be completed only if the service location is technically ready and meets the minimum requirements prescribed for the product. The user is responsible for ensuring the availability of appropriate electrical points, power supply, mounting surfaces, space clearance, ventilation, structural support, and any other conditions necessary for safe and compliant installation.

If installation cannot proceed due to missing electrical points, incompatible fittings, obstructed access, unsafe conditions, or any structural limitations, the appointment may be delayed, rescheduled, or marked incomplete. Any delay, additional visit, or inability to complete installation arising from lack of site readiness shall not be attributable to us.

Indemnity

The User shall indemnify and hold Checkme Commerce harmless against claims, losses, or damages arising from inaccurate information, unsafe premises, lack of permissions, misuse of the Platform, violation of these Terms, or actions causing harm to technicians.

Disclaimer of Warranties and Liability

The Platform and all services made available through it are provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the availability, accuracy, completeness, reliability, or suitability of the Platform or any service information displayed on it. We do not guarantee uninterrupted access, error-free operation, or that the Platform will remain free from viruses, harmful code, or technical disruptions.

We provide demonstration and installation services only. We do not manufacture, sell, supply, service, or repair any product, nor do we control or influence product quality, performance, durability, or functionality. We are not responsible for any product defect, malfunction, design flaw, or inherent issue in any product demonstrated or installed. All responsibilities relating to product defects or warranty remain exclusively with the respective manufacturer or seller.

We are not liable for delays, incomplete services, or failed appointments resulting from lack of site readiness, unavailable customer premises, incorrect product information, power supply issues, access restrictions, unsafe conditions, or any other circumstance outside our control. We are not liable for any indirect, incidental, special, punitive, or consequential loss, including loss of use, loss of data, loss of opportunity, or loss arising from product failure.

Technician recommendations, installation guidance, or demonstration-related information do not constitute warranties, product assurances, or technical guarantees. Our liability is limited strictly to the performance of the demonstration or installation service itself.

Data Protection

Your personal data is collected and processed only for providing demonstrations, installations, scheduling, communication, and related operational functions. Use of the Platform constitutes your consent to such processing. All data handling is governed by our Privacy Policy, which forms an integral part of these Terms. You should review the Privacy Policy to understand how your information is collected, used, retained, and protected in accordance with the Digital Personal Data Protection Act, 2023.

Communications and Notifications

By using the Platform, the User consents to receive communications relating to bookings, service updates, scheduling, confirmations, cancellations, and operational messages through SMS, phone calls, email, WhatsApp, or in-app notifications. Technicians may contact the User directly to coordinate arrival and access.

Third-Party Services

We may engage third-party logistics providers, independent technicians, service partners, or other external entities to support the delivery of demonstrations, installations, and related services. These third parties operate independently, and their actions, delays, conduct, availability, or performance are outside our direct control. We are not responsible for any delay, failure, error, or disruption in service arising from the acts or omissions of such third parties or from external conditions beyond our control, including traffic, weather, network outages, or operational constraints.

Entire Agreement

These Terms constitute the entire agreement between the User and Checkme Commerce regarding Platform use and Services. No verbal statements or assurances modify these Terms.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with the Platform or the services provided shall be subject to the exclusive jurisdiction of the courts situated in Ahmedabad, Gujarat.

Amendments

We may revise, update, or modify these Terms at any time. Any changes take effect once published on the Platform. Your continued access or use of the Platform after such publication constitutes your acceptance of the revised Terms.

Security

The User shall not attempt to undermine or interfere with the security, integrity, or performance of the Platform. Any attempt to breach systems, access data without authorization, or disrupt service operations may result in immediate termination of access.
